Mission College Academic Senate

Recommendations on Contract Education

The recommendations included herewith are based on the WVMCCD Academic Senate's Position Paper on Contract Education and incorporate the concluding recommendation of the Mission Collegeís Presidentís Response on Contract Education issued on January 12, 1998.

The subcommittee makes the overall recommendation that the WVMCCD Academic Senate's Position Paper on Contract Education be taken to the Board of Trustees for discussion, information and/or adoption.

1. Right to offer courses:

Recommendation 1: That the following statements are givens:

ïThe recommendations made in this document relate to all courses, both credit and not for credit, offered through Contract Education under Mission College's Accreditation.

ïAll expenses incurred by Mission College departments in fulfilling any contract negotiated by Contract Education will be born by Contract Education including (but not limited to): hiring, instructor evaluations , duplication, supplies and equipment, library usage, student services, etc..

ïThe department's decision to offer a course is dependent on satisfying the following academic and professional criteria: Instructor qualification

Grading policies

Approval of course content

Adequacy and availability of facilities

Instructor evaluation

Availability of qualified faculty

Ability of department to support the contract

Agreement on remuneration to department for work

Recommendation 2: Departments reserve the right to offer only courses in which the curriculum meets the academic standards of the department. Included in this recommendation is that Contract Education staff will refrain from promoting potential (credit and not for credit) courses without first consulting with and gaining the approval of the department. Departments must be involved from the planning stages of any contract and be given sufficient lead time to provide for curriculum development, planning, and staffing.

Recommendation 3: A Mission College faculty member be reassigned on a 1.0 load to act as liaison between Contract Education and Mission College to ensure initial compliance with academic and professional standards.

Recommendation 4: The Dean of Instruction shall be the first level of intervention to try to resolve any conflicts that arise between Contract Education and the department.

Recommendation 5: That the Mission College Academic Senate create a Senate Contract Education Committee on Academic and Professional Matters for the purpose of mediating conflicts unresolved by the Dean of Instruction. This committee would recommend to the Senate a course of action regarding the offering of courses.

Recommendation 6: Process: See Flow Chart (hasn't yet been updated to include the Dean of Instruction as an intermediate step before the Senate Contract Education Committee on Academic And Professional Matters.)

2. Hiring process for instructors

Recommendation 1: Faculty hiring will follow all approved Human Resources policies and procedures, and adhere to the ACE contract on matters related to qualification and/or equivalency for regular and associate faculty. All Human Resources and ACE negotiated processes will be followed. Implicit in this recommendation is the understanding that in faculty hiring, approval rests with the department.

3. Evaluation process for instructors

Recommendation 1: All instructors must be evaluated per the ACE contract for any credit and not for credit course through Mission College.

4. Faculty load

Recommendation 1: That ACE negotiate that full-time faculty may use courses offered through Contract Education to comprise their 1.0 load or use them as overload. But, that full-time faculty cannot be forced to teach in Contract Education to make their 1.0 load if the 1.0 load is available. Faculty teaching in Contract Education (even if a full time faculty member is able to assemble a full 1.0 load) still maintain their committee responsibilities and all other professional obligations.

5. Communication

Recommendation 1: To support open communication with departments and facilitate planning, Contract Education should maintain a public list of current and planned course offerings. This list could be updated weekly or monthly on the Mission College home page.

Recommendation 2: In the spirit of shared governance and open communication, Contract Education should regularly report its financial status. Information regarding expenses and income should be openly shared. Implicit in this recommendation is that Contract Education has been developing an accounting system for many years, but none has been forthcoming.

6. Compensation

Recommendation 1: Recommend to ACE to negotiate any/all of the following:

ïCompensation for curriculum development

ïCompensation for hiring faculty

ïCompensation for off campus teaching differential

ïCompensation for course management including:

instructor evaluation

instructor absence

materials ordering

duplicating

lab and materials fees

ïCompensation to departments for course offerings

Recommendation 2: Recommend that the Facilities Department determine the cost of maintenance and wear and tear on Mission College facilities to be reimbursed by Contract Education.

Recommendation 3: Contract Education shall provide a set amount of money into an account to provide necessary student services, including but not limited to: Counseling, Advising, Library Services, Media Services, Tutorial Services etc.
